A Case Report about Doubting a Miscondition of Publication by a Third Party based on the Confusing Ownership of Databases

Abstract
A case of publication misconduct by a third party was recognized during some activities of academic consultations. The third researchers (TR) obtained a raw database (RDB) by an illegal way and presented the results in an academic conference without permission of original researchers (OR) who constructed RDB. In addition, TR has awarded a contract without discussion with OR. The aim of contract is to re-verify the results of OR using the RDB, but OR already published the results in an international, peer-reviewed medical journal. Consequently, TR has unwillingly made author doubt the misconducting publication ethics such as authorship, falsification, and plagiarism, as well as copyright infringement. This case let academic societies alarm to complement the rules about ownership of RDB. A good rule of thumb is to discuss with OR under keeping scientific ethics before using the RDB.
